These Terms of Service (“Terms”) govern your access to and use of fiecom.com (the “Platform”) and any services, applications, tools, and features offered by Fiecom.

By creating an account, accessing, or using any part of the Platform, you agree to be bound by these Terms.

If you do not agree, you must not use the Platform.

1. About Fiecom

Fiecom provides a software platform that enables users (“Sellers”) to generate, manage, and sell AI-generated digital products such as ebooks, guides, templates, and online courses.

Fiecom acts solely as a technology provider and intermediary between Sellers and Buyers.

Fiecom is not a party to any transaction between a Seller and a Buyer.

All payments are processed through Stripe Connect, and each Seller is solely responsible for their own products, pricing, tax obligations, and compliance with applicable laws.

2. Eligibility

You must:

• Be at least 18 years old (or the age of majority in your jurisdiction).

• Have full legal capacity to enter into a binding contract.

• Provide accurate and complete information when creating an account.

If you are using Fiecom on behalf of a business, you represent that you have the authority to bind that entity to these Terms.

3. Relationship Between Fiecom and Sellers

Fiecom does not buy, sell, or own any products sold through the Platform.

Sellers act as independent entities, not employees, partners, or agents of Fiecom.

Sellers are solely responsible for:

• The legality, safety, and accuracy of their products.

• Customer service, refunds, and support.

• Payment of taxes and compliance with consumer protection laws.

Fiecom is not liable for any actions, representations, or omissions of Sellers.

4. Use of AI-Generated Content

The Platform provides access to AI tools that generate text, images, and other content based on user prompts.

By using these tools, you acknowledge and agree that:

1. AI-generated content may be inaccurate, incomplete, biased, or similar to existing works.

2. You are fully responsible for reviewing, editing, and verifying any AI-generated content before publishing or selling it.

3. Fiecom makes no warranty or guarantee as to the originality, legality, or suitability of AI-generated products.

You agree to indemnify and hold Fiecom harmless from any claim related to AI-generated content you use or sell.

5. Account Registration and Security

To sell on Fiecom, you must create an account and connect a valid Stripe Connect account.

You are responsible for:

• Maintaining confidentiality of your login credentials.

• All activity occurring under your account.

• Promptly notifying Fiecom of unauthorized access.

Fiecom may suspend or terminate any account at its discretion for violation of these Terms or suspicious activity.

6. Payments, Payouts, and Fees

• All transactions occur directly between the Buyer and the Seller through Stripe Connect.

• Fiecom never stores or directly handles your funds.

• Stripe deducts applicable processing fees from each sale.

• Fiecom may charge an additional platform fee, clearly displayed prior to checkout.

• Sellers receive payouts directly from Stripe according to Stripe’s own payout schedule and policies.

You agree that:

• Fiecom is not responsible for payment delays, failed transfers, or disputes arising through Stripe.

• You are responsible for connecting and maintaining a valid Stripe account.

• You must comply with all Stripe Connect terms (available at stripe.com/connect-account/legal).

7. Taxes and Regulatory Compliance

Each Seller is fully responsible for determining and remitting any taxes, including sales, VAT, or income tax, arising from transactions made through Fiecom.

Fiecom does not withhold or remit taxes on behalf of Sellers or Buyers.

You agree to indemnify Fiecom against any tax liability or penalties arising from your failure to comply with applicable tax laws.

8. Refunds and Customer Service

All products sold on Fiecom are digital goods, delivered instantly and non-refundable by default.

Sellers may choose to offer refunds at their own discretion.

Buyers seeking support or refunds must contact the Seller directly.

Fiecom is not responsible for:

• Handling customer disputes.

• Issuing refunds.

• Guaranteeing the performance or satisfaction of any product.

9. Intellectual Property

9.1 Seller Content

Sellers retain ownership of any content or digital products they upload, generate, or sell through Fiecom.

By using the Platform, you grant Fiecom a non-exclusive, worldwide, royalty-free license to host, display, and promote your content for the purpose of operating and improving the Platform.

9.2 Platform IP

All elements of Fiecom, including design, branding, software, databases, and trademarks, are owned by Fiecom and protected under intellectual property laws.

You may not reproduce, distribute, or exploit any part of the Platform without written consent.

10. Prohibited Activities

You agree not to:

• Upload, generate, or sell illegal, offensive, or infringing content.

• Mislead buyers or impersonate other creators.

• Circumvent Stripe or process off-platform payments.

• Distribute malware, spam, or attempt to hack the Platform.

• Use AI-generated content in ways that violate copyright or privacy laws.

Violation may result in immediate termination of your account and reporting to authorities.

11. Disclaimer of Warranties

The Platform and all services are provided “as is” and “as available.”

Fiecom makes no warranties or guarantees regarding:

• The accuracy, reliability, or completeness of AI outputs.

• The performance, revenue, or sales outcomes of your products.

• Continuous or error-free access to the Platform.

  
  

You use the Platform at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

• Fiecom shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform or sale of your products.

• In no event shall Fiecom’s total liability exceed the total fees you paid to Fiecom in the preceding three (3) months.

This limitation applies regardless of legal theory, even if Fiecom has been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fiecom, its officers, employees, affiliates, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of:

• Your use of the Platform or Stripe.

• Your violation of these Terms.

• The sale, content, or marketing of your AI-generated products.

• Any third-party claims regarding intellectual property or consumer protection violations.

14. Account Termination

Fiecom may, at its sole discretion and without notice:

• Suspend or delete your account for violation of these Terms.

• Restrict access to your dashboard or product pages.

• Remove any product or listing that may harm users or the Company.
  
  

Upon termination, your access to all Platform features will cease, and you remain responsible for all obligations and liabilities accrued prior to termination.

15. Data & Privacy

Your use of the Platform is subject to our Privacy Policy, which outlines how personal data and payment information are collected, stored, and processed.

You agree that Fiecom may share limited account and transaction data with Stripe and other third-party processors for legitimate business purposes.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

17. Changes to Terms

We reserve the right to modify or update these Terms at any time.

Changes will become effective upon posting on this page, with the updated “Last Updated” date.

Your continued use of Fiecom constitutes acceptance of the revised Terms.
